8.1Employers’ liability
What to enter
Choose Held, Not legally required or Required but not held. Give current evidence or the reason the legal duty does not apply. A statutory exemption or being outside the duty’s scope needs a basis, not an unexplained N/A.
Where the UK statutory duty applies, EL is generally required with at least £5 million cover. A required but missing policy is an open compliance issue, not something an addendum can waive.

- Find the current employers' liability certificate in your insurance documents, broker emails or insurer portal.
- Check the insured entity and policy dates. Reference the current certificate or ask the broker for a replacement copy.
- If you believe cover is not legally required, confirm the basis against the applicable guidance and your circumstances before selecting that answer.

Public liability and employers' liability are different covers. Ask the insurer or broker to clarify an unclear policy; do not use a quote as evidence of cover already held.
8.2Other cover held
What to enter
Select the cover you currently hold: public liability, product liability and/or professional indemnity. Select None only if none is held. Reference the evidence. Detailed limits, exclusions, territories and activity scope are requested when relevant.
Where to find it / what to do next
- Use the current policy schedule or ask your broker which covers are in force for the contracting company.
- Tick only the covers held and reference the evidence. A renewal proposal or a cover you intend to purchase is not an active policy.
8.3Financial delivery risk
What to enter
Disclose an insolvency process, going-concern concern or other material financial issue likely to impair delivery. Use 11.1 for the effect and proposed mitigation. There is no routine request for full accounts from every supplier.
RCDEN may request proportionate financial evidence for a particular commitment. A new or audit-exempt business can propose appropriate alternative evidence; it should not invent an audited history.
Where to find it / what to do next
- Ask the director or finance lead whether any material financial issue could prevent delivery of the proposed work.
- If there is an issue, explain its likely effect and proposed action in 11.1. You do not need to attach full accounts unless they have been requested for a reason.
